When a person is arrested, they are formally charged and will get magistrated by a municipal judge or a justice of the peace. Once magistrated, the defendant has three options: 1) wait in jail until the defendant is found guilty, not guilty, or charges are dismissed. 2) pay the full amount of the bond set by the magistrate. If the full amount of the bond is paid at the Hidalgo County Sheriff’s Office, that amount is refunded once the defendant is judged guilty, not guilty, or the charge is dismissed. 3) hire a bonding company to post the bond. Hidalgo County Bail Bondmen are available 24/7/365 and provide jail release to defendants once they are magistrated and given a bond amount. Bail bondsmen will visit with family and the defendant to assess the risk of the defendant. Once the price and a contract has been agreed to, the bonding company will post the bond at the Hidalgo County Sheriff’s Office. A short time later the defendant is released and reunited with his/her family. This service is tax free to the public because bail bondsmen use their own money and assets.

As part of the contract with the defendant and their family, the bail bond company will use many items at their disposal. The bail bond company will use different electronic tools to verify defendant’s information. The bail bond company will work with the defendant’s family and friends to ensure compliance. The bonding company will supervise the defendant as they await trial.


The bail bond company remains in constant communication with the defendant to ensure their appearance in court. If the defendant fails to appear, the bonding company is financially responsible. At this point, the bonding company hires a licensed private investigator to locate and arrest the defendant.

Only a small fraction of Texas Counties can afford to monitor defendants while out on PR Bond (Personal recognizance). In these cases, there is no monitoring of the defendant. There is no incentive for the defendant to appear in court. This abdication of justice has led to tens of thousands of outstanding warrants and the cost to taxpayers is in the millions. A recent study done by a university in DFW Metroplex approximates the cost to be upwards of $1,100 per warrant.

Local taxpayers will have the burden of paying law enforcement to have these defendants taken into custody. The cost and manpower effort to arrest these defendants, could be used to benefit some other local useful program. Bail bond companies have been doing this at no cost for well over a hundred years.

Studies have shown, the failure to appear (FTA) rate of PR bonds is higher than those of the bail bond companies. Some of these criminals are simply not showing up to court, because they realize there isn’t anyone looking for them. This means, law enforcement will most likely have to create a task force to locate and arrest these defendants. In some cases, there may be new victims because crime will increase in the local community.

Most Hidalgo County residents don’t really understand how the bail bond system works. In fact, this system has operated since the day our county was founded. If eliminated, our local government will be charged with tracking these defendants. If bail is eliminated, Hidalgo County will be replacing private industry with a new bureaucracy, thus increasing in taxes and crime.
